CHALLENGES WILL BE CONDUCTED BY DESIGNATED REGIONS, AS DETERMINED BY UPS IN ITS SOLE DISCRETION (EACH A “PARTICIPATING REGION”). NOT ALL UPS REGIONS ARE PARTICIPATING.
THE CONTEST IS OPEN ONLY TO BUSINESS ENTITIES THAT ARE INCORPORATED AND REGISTERED TO CONDUCT BUSINESS UNDER THE LAWS OF ONE OF STATES INCLUDED IN A PARTICIPATING REGION. PARTICIPATING REGIONS MAY BE DESIGNATED FOR SOME, BUT NOT ALL OF A STATE. AS A RESULT, NOT ALL BUSINESSES IN A STATE MAY QUALIFY FOR THE CHALLENGE IN A PARTICIPATING DISTRICT DEPENDING ON THE PRINCIPLE BUSINESS ADDRESS FOR THE BUSINESS (each eligible business is a “Qualifying Business Entity”).
APPLICATIONS WILL BE ENTERED INTO THE UPS X-PORT CHALLENGE FOR A REGION BASED ON THE PRINCIPLE BUSINESS ADDRESS FOR THE QUALIFYING BUSINESS ENTITY.
The UPS X-PORT Challenge 2017 ("Contest") is sponsored by United Parcel Service General Services Co., 55 Glenlake Pkwy., Atlanta, GA, 30328 USA (referred to in these official rules as “UPS”). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, each entering business entity and any individual submitting an entry on behalf of a business entity agrees to these Official Rules, including all eligibility requirements, and understands that the results of the Contest are final in all respects. The Contest is subject to all federal, state, and local laws and regulations and is void where prohibited by law. FINALISTS MUST BE ABLE TO ATTEND THE PITCH-OFF EVENT TO BE ELIGIBLE TO WIN.
ELIGIBILITY. Contest is not open to the general public. Contest is open only to Qualifying Business Entities. Employees, officers and directors of UPS, their subsidiaries and affiliates and their respective consultants, representatives, agents and suppliers, and the Contest judges (collectively, “Contest Entities”) are not eligible to enter or win. UPS reserves the right to verify the eligibility of all participating business entities. NO ONE MAY ENTER IN HIS/HER INDIVIDUAL CAPACITY. ALL APPLICATIONS MUST BE SUBMITTED ON BEHALF OF AN ELIGIBLE BUSINESS ENTITY BY AN EMPLOYEE OR OWNER OF THAT ELIGIBLE BUSINESS. ANY EMPLOYEE SUBMITTING AN APPLICATION ON BEHALF OF HIS OR HER EMPLOYER MUST HAVE AUTHORIZATION OF HIS OR HER EMPLOYER TO SUBMIT THE APPLICATION FOR THAT APPLICATION TO BE ELIGIBLE. SUCH AUTHORIZATION MUST INCLUDE THE ELIGIBLE BUSINESS ENTITY’S AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES, INCLUDING, BUT NOT LIMITED TO, THE PROVISIONS PERTAINING TO THE RELEASE OF CERTAIN RIGHTS IN AND TO THE APPLICATION.
HOW IT WORKS:
Visit the Contest website located at http://ups.com/xportchallenge (the “Contest Website”) and follow the instructions to submit a request for an application. Following receipt of the online request for application, the business contact designated on the request form for the Qualifying Business Entity will receive an email from the District representative to which your business has been designated. Please ensure that the email settings are set to receive emails. UPS is not responsible for failure of delivery of the email for any purposes, including spam filter settings.
The email will contain the application form and additional instructions for submitting an application for the Contest. To complete the form, the required contact information must be provided and answers to the questions must be entered/pasted into the designated boxes (the “Application”). The email will also contain the Contest entry period and deadline for submissions of entries for your assigned District (the “Contest Entry Period”). Applications must be submitted in the manner designated on the email from the District. Entries submitted by any other means may be disqualified.
The Application must be about a product(s) that the Qualifying Business Entity has launched in the U.S. market or has in development with plans to launch in the U.S. market by no later than end of 2018.
NOTE: UPS shall have no obligation to maintain any of the entries or Application or information or ideas contained therein as confidential or proprietary. Entrants should not include confidential or proprietary information within any entry or Application submitted in connection with the Contest.
The answers to the questions in the Application must be no longer than the maximum word length provided on the Application. Application must be received during the Contest Entry Period to be eligible. Limit of one Application per Qualifying Business Entity.
AN APPLICATION MAY BE SUBMITTED BY AN INDIVIDUAL WHO IS AN OWNER OR EMPLOYEE OF AN ELIGIBLE BUSINESS; HOWEVER, EACH APPLICATION WILL BE DEEMED TO HAVE BEEN SUBMITTED ON BEHALF OF THE ELIGIBLE BUSINESS IDENTIFIED IN THE APPLICATION. PRIZES WILL BE AWARDED TO THE OWNER OF THE ELIGIBLE BUSINESS IN THE NAME OF THE ELIGIBLE BUSINESS, REGARDLESS OF WHO MAY HAVE SUBMITTED THE APPLICATION.
All components of the Application must have been created solely by the individual employee or owner submitting the Application and be that person’s own original creation, created solely by entrant. Applications may not have been published previously, in whole or in part, or have been entered into any other contest or won any other award. Modifying, enhancing, or altering a third party's preexisting work does not qualify as an original creation of the individual submitting the Application. By entering this Contest, each entrant represents that he or she owns all right, title, and interest in the submitted entry and has the authority to grant to UPS the rights provided in these Official Rules. Falsification of information in the entry or instances of infringement of the rights of others may result in disqualification. Entrants must adhere to all laws and regulations concerning use of material owned by others. No entry may contain material that violates anyone’s privacy or other rights or that is offensive, profane, contains nudity, or political references, or that defames or causes embarrassment to others. Any Application that contains third-party property or materials or elements not owned by the individual submitting the Application, contains offensive language, violates anyone’s privacy, or does not comply with any aspect of these Official Rules may be disqualified. The individual submitting the Application represents and warrants that his/her right to submit and permit use by UPS of the Application or the information it contains is not restricted in any way.
Receipt of an Application will not be acknowledged, and proof of submission of an Application will not be deemed proof of receipt. UPS has no obligation to advise an entrant of an incomplete or non-compliant Application. UPS is not responsible for lost, late, invalid, unintelligible, incomplete, garbled, or misdirected Applications, which will be disqualified.
JUDGING PROCESS. Judging for each District will occur in two rounds (“Round One” and “Round Two”) as described in more detail below.
ROUND ONE. For Round One, there will be a judging panel consisting of UPS employees and judges selected by UPS, the identities of whom may remain anonymous. In Round One, the judging panel will select ten (10) finalists from the entries for the designated District (each a “Finalist”) to participate in Round Two (the “Pitch-Off Event”).
For the purpose of determining the Finalists from Round One, each Application will be judged by the judging panel. Election of the Finalists remains at the discretion of the judges based on the applicable judging criteria. In the event that judging for any round ends in a tie, the applicable judging panel will judge the tied Applications again until the Finalists are determined. All decisions of the judging panel are final and binding in all respects. Qualifying Business Entities selected as potential Finalists will be notified by the District representative according to contact information provided with the Application.
As part of the verification process, UPS reserves the right to verify the accuracy of the information contained in any entry (including in any Application), and to otherwise investigate the eligibility of any entering business or any individual submitting an Application. A potential entrant’s ability to be named as a Finalist or right to receive a Contest prize shall be subject to such investigation and verification by UPS. UPS shall have the right to disqualify any Application that contains any false, inaccurate or misleading information.
If a potential Finalist cannot be contacted within three (3) business days following attempted notification or the notification is returned as undeliverable, the potential Finalist may be disqualified and an alternate Finalist selected, time permitting. Each potential Finalist will be required to sign an affidavit of Contest eligibility and a publicity release and assignment agreement, as well as applicable tax forms, including but not limited to a W-9 (collectively, the "Contest Documentation"). The Contest Documentation must be fully completed and returned within seven (7) days following receipt of the forms from Sponsor. If a potential Finalist does not provide the completed Contest Documentation or is unable or unwilling to participate in the Pitch-Off Event on the dates and at the location designated by UPS, that potential Finalist may be disqualified and an alternate Finalist selected, time permitting.
ROUND TWO – THE PITCH-OFF EVENT. The Finalists for each District will be invited to participate in the Pitch-Off Event for that District. Finalists will be notified by email and/or phone according to contact information provided with the Application, including, the date, time and location for the Pitch-Off Event.
Each Qualifying Business Entity is solely responsible for its own costs and expenses, including, travel, lodging and associated expenses with travel to and from and attendance at the Pitch-Off Event.
During the Pitch-Off Event, one (1) representative from each Finalist will present the product(s) identified in the Application and demonstrate why that product(s) has global appeal. The time period and rules and requirements for the Pitch-Off Event will be provided prior to the Pitch-Off Event. A judging panel consisting of representatives appointed by UPS will evaluate each Finalist presentation based on the judging criteria established by the panel. The judging panel will collectively select the top three (3) Finalists of the Pitch-Off Event (the “Pitch-Off Winners”). The Pitch-Off Winners will be notified at the Pitch-Off Event.
PRIZES. Information regarding the prizes that are to be awarded to Pitch-Off Winners for each District will be communicated by the District representatives to the Finalists at the time of notification regarding the Pitch-Off Event.
Grand Prize: A $10,000 USD credit for UPS export services, which shall be applied to the UPS shipping account number of the first-place Pitch-Off Winner.

All credits for UPS export services that may be awarded as part of a prize must be redeemed and used for applicable services by no later than December 31, 2019. The UPS export services will be provided subject to the standard terms and conditions applicable to such UPS services. Certain restrictions and exclusions may apply. Each Pitch-Off Winner must have a valid UPS account to use the UPS export services.
ROUND THREE – THE PITCH-OFF EVENT
The winner of each regional competition will be included in a virtual run-off to be hosted on UPSers.com where internal UPS employees will vote on which product is export worthy. The top 3 contestants with the most votes will be invited to a national pitch-off competition held the 1st quarter 2018 to pitch-off in front of members of the UPS management team for an opportunity to win the following cash prizes to assist the business with export growth:
Grand Prize: $25,000
2nd Place: $15,000
3rd Place: $10,000
UPS makes no warranties, representations or guarantees relative to any third party product or service provided as part of the prize, and disclaims all liability for the provision, use, quality or nature of any third party product or service. UPS does not endorse or certify the products or services provided by any third party, and UPS makes no representations as to the quality, reliability, or performance of the products or services offered by any third party. The winner’s decision to use any of the products or services of a third party provided with any prize should be based on the winner’s own informed evaluation of the product or service provider.
Except for the prize value, Pitch-Off Winners will not receive any additional monetary compensation or acknowledgement for participation in Contest. The prizes are not redeemable for cash. Except as specifically provided herein, each Pitch-Off Winner is solely responsible for all expenses and fees incurred to participate in this Contest, including, without limitation, taxes related to receipt or use of the prize. Reporting and payment of all applicable taxes, fees, or surcharges, if any, resulting from acceptance or use of a prize are the sole responsibility of the Pitch-Off Winner. FINALISTS AND PITCH-OFF WINNERS ARE RESPONSIBLE FOR ALL APPLICABLE TAXES AND EXPENSES THAT SHALL BE DUE AS A RESULT OF ACCEPTANCE AND USE OF ANY CONTEST AWARD, INCLUDING, BUT NOT LIMITED TO, INCOME TAXES. If UPS cannot find a sufficient number of potential Finalists for a District able to satisfy all requirements from among the entries received, some or all of the prizes may not be awarded.
All Applications shall become the exclusive property of UPS upon submission. Applications will not be returned. By entering this Contest, each entering business, and the employee or owner submitting the entry, unconditionally and irrevocably grants to UPS (and those acting pursuant to the direction of UPS) a perpetual, worldwide, royalty-free, irrevocable, and fully-transferable right and license to use, display, reproduce, communicate, publish, abridge, translate, and otherwise exploit the entry and Application (without approval of or compensation to an individual that submits an entry or to any business on behalf of which an entry is submitted) for promotional purposes in any media or manner worldwide. Any individual submitting an Application hereby waives in favor of UPS any moral rights, “droit moral,” rights of attribution or similar rights the individual might otherwise have in or to the Application. To the maximum extent permitted by law, UPS reserves the right to edit, modify, or abridge any Application for any reason prior to use. Entrants agree that there is no guarantee that UPS will make use of any rights granted to UPS in the Application or publicize the Application or entrant in any manner.
Entrants acknowledge and agree that UPS may have products or services that are similar or competitive to the ideas and concepts provides in the Application and nothing shall impair UPS’s rights to develop, make, use, procure, or market products or services now or in the future that may be similar or competitive with those in the Applications.
ADDITIONAL LIMITATIONS. Each prize is non-transferable. Prizes cannot be used in conjunction with any other promotion or offer. No substitution or cash equivalent of prize is permitted; however, UPS reserves the right to substitute the prize with another of equal or greater value. The Contest Entities are not responsible for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in the printing or posting of the offer or these Official Rules, the selection and announcement of the Finalists and Pitch-Off Winners, or the distribution of the prizes. Any attempt to damage the content or operation of the Contest is unlawful and subject to legal action by UPS or its agents. UPS reserves the right to terminate, withdraw, or amend the Contest (in its entirety or for a particular District) or to disqualify any entry for any reason and without notice, including - without limitation - if UPS suspects tampering has occurred, to void the entries at issue or terminate the Contest (in its entirety or for a particular District) and select Finalists and/or Pitch-Off Winners from among that portion of the Contest (in its entirety or for a particular District) that has not been compromised, if any. Contest Entities will not replace any lost or stolen prize items. The Contest Entities and any telephone network or internet service providers are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any network, computer equipment or software malfunction, the inability to access any web site or online service, or any other error, human or otherwise.
INDEMNIFICATION AND LIMITATION OF LIABILITY. BY ENTERING THE CONTEST, EACH INDIVIDUAL SUBMITTING AN APPLICATION AND EACH ENTERING BUSINESS ENTITY AGREES TO INDEMNIFY, RELEASE, AND HOLD HARMLESS THE CONTEST ENTITIES AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES, OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM PARTICIPATION IN THE CONTEST OR THE ACCEPTANCE OF ANY PRIZE THAT MAY BE WON. THERE ARE NO WARRANTIES OR GUARANTEES, AND THE CONTEST ENTITIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AS TO THE CONDITION, FITNESS, OR MERCHANTABILITY OF ANY PRIZE. EACH INDIVIDUAL SUBMITTING AN ENTRY AND EACH ENTERING BUSINESS ENTITY AGREES, UPON REQUEST OF UPS, TO EXECUTE OR CAUSE THE EXECUTION OF ANY DOCUMENT CONTAINING OR IMPLEMENTING THE TERMS AND CONDITIONS OF THESE OFFICIAL RULES. THE CONTEST ENTITIES AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
PUBLICITY AND GENERAL. By submitting an Application, each business entity grants UPS and those acting under its authority permission to use the business’ company name and trademarks and comments for advertising and publicity purposes in connection with the Contest and promotion of the Contest. Any individual owner or employee submitting an entry form thereby grants to UPS and those acting under its authority permission to use his/her name, likeness, and comments for advertising and publicity purposes, except where prohibited by law. Any use of the foregoing by UPS or those acting under its authority for publicity purposes shall be without payment of consideration, except as provided for by these Official Rules.
GOVERNING LAW. To the maximum extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants and the Contest Entities in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the United States, the State of Georgia, without giving effect to any choice of law or conflict of law rules or provisions.
WHO WON. The names of the Finalists and Pitch-Off Winners for each District shall be posted on https//ups.com/xportchallenge after selection and verification of the winners, for a period of approximately one (1) month.
